The Seller also warrants that the Seller has the full right and authority to sell and deliver the Motor Vehicle and that the Seller will defend the title of the Motor Vehicle against any and all claims and demands except the Security Interest.

'AS IS' CONDITION: The Purchaser acknowledges that the Motor Vehicle is sold 'as is'. The Seller expressly disclaims any implied warranty as to fitness for a particular purpose and any implied warranty as to merchantability. The Seller expressly disclaims any expressed or other implied warranties.

WORKING ORDER: Any warranty as to the condition or working order of the Motor Vehicle is expressly disclaimed by the Seller.

MANUFACTURER'S WARRANTY: Any disclaimer of warranties by the Seller in this Bill of Sale will not in any way affect the terms of any applicable warranties from the manufacturer of the Motor Vehicle.

LIABILITIES: The Seller does not assume, nor does the Seller authorize any other person on the behalf of the Seller to assume, any liability in connection with the sale or delivery of the Motor Vehicle.

INSPECTION: The Purchaser accepts the Motor Vehicle in its existing condition given that the Purchaser has either inspected the Motor Vehicle or was given the opportunity to inspect the Motor Vehicle but chose to not inspect it.

GOVERNING LAW: This Bill of Sale will be construed in accordance with and governed by the laws of the State of Arizona.

In the state of Arizona, the bill of sale represents legal documents which facilitate the exchange of ownership for different kinds of property. For validity, the state requires you to include specific information about the property ownership exchange in the free Arizona bill of sale form. But, when it comes to small personal items, the BOS isn’t always needed within the State. So, when do you need the BOS?

Motor Vehicles BOS in Arizona

The motor vehicle BOS is the legal document that records the details of the transactions involved between two parties transferring the ownership of a motor vehicle. Like in most other states, the BOS for motor vehicles should be created according to the regulations set by Arizona’s DMV (Division of Motor Vehicle). Under the state laws, the parties in the motor vehicle BOS are the seller of the vehicle as well as the party buying the vehicle.

Note: unlike other departments dealing with motor vehicles, Arizona’s motor vehicle division doesn’t need the BOS for the transfer of titles and the completion of other transaction. The only reason why the BOS still exists and why recommend its use in the state is for the protection of the buyer and the seller; this is in accordance with Form 48-2004, the AZ BOS. While this document requires the seller’s signature only, it’s wise for the buyer to sign the document as well to acknowledge the participation of both parties in the transfer.

Still wondering why an AZ BOS is essential although the motor vehicle division in Arizona doesn’t need it? Well, it serves two other roles.

Seller protection: The BOS will protect a seller from any liability resulting from the actions of the buyer after the sale is complete. The AZ motor vehicle division will give you a sold notice for liability, but the BOS gives you information about the buyer (price paid, name and contact information, and date the vehicle was sold).

Benefits to buyer: besides being the record of the purchase, it gives other details like the buying price of the car. The purchase price is necessary during the car’s registration.

General BOS in Arizona

Are you planning to sell that old television, laptop, home theatre system or furniture? Get a general BOS. The BOS will have the name of the buyer and the seller and any other information about the item on sale.

Arizona laws require that the seller includes a paragraph explaining if the buyer takes the asset ‘as is” or if a guarantee for the item exists. The serial or model number and a specific description of the item are also necessary.

The amount given in exchange for the item should also be highlighted – the value in words first then in numbers.

The buyer and seller should sign the general BOS in the presence of the notary.

BOS for Boats in Arizona

If selling a boat, the BOS for the sale of a boat will protect your rights and rights of the buyer. The BOS has details of the buyer’s and the seller’s name, the driver’s license number, and the physical address. It should also carry specific information about the boat: the length, make, year, registration, hull ID, title number, and the odometer readings (in hours.

Since boats on sale come with trailers, the BOS should indicate whether or not the trailer is included. When present, the make and model of the trailer should be included. Also, make, horsepower, and year should be highlighted in a purchase with an outboard motor.
